Document Forgery: Lagos Court Jails Notorious Fraudster Nwude.
Justice Mojisola Dada of the Special Offences Court in Ikeja, Lagos, has sentenced notorious fraudster Emmanuel Nwude and two lawyers, Emmanuel Ilechukwu and Rowland Kalu, to one year in prison each for forgery and unlawfully dealing in forfeited property.....KINDLY READ THE FULL STORY HERE▶
The trio were convicted on Wednesday, March 11, following a prolonged legal battle that began years ago after they were arraigned on several criminal charges.
Nwude and the two lawyers were initially brought before the court on March 2, 2018, on an amended 15-count charge bordering on conspiracy, forgery, uttering forged documents, illegal dealings in forfeited property, attempting to obstruct justice, and fabricating evidence.
All three defendants pleaded not guilty at the time, leading the court to order a full trial.
The prosecution alleged that between 2011 and 2012, the defendants unlawfully handled a property located at Plot Y, Mobolaji Johnson Street, Oregun, Ikeja, without approval from the appropriate authorities. According to prosecutors, the defendants were aware that the property had earlier been forfeited to victims of crime as restitution following a judgment delivered on November 18, 2005, in a case involving Nwude and other defendants.
The property was later sold by the victims to Rosaab Industrial Design Limited, which subsequently transferred it to G. C. Nweze and Company Limited.
During the trial, the prosecution, led by Nnaemeka Omewa, presented five witnesses and submitted several documents as evidence, all of which were admitted by the court before the prosecution closed its case on March 19, 2019.
Afterward, the defendants filed a no-case submission, arguing that the prosecution had failed to establish a prima facie case against them. However, in a ruling on September 19, 2019, Justice Dada dismissed the application and ordered them to open their defence.
Rather than immediately proceeding with his defence, Nwude approached the Court of Appeal to challenge the trial court’s ruling, seeking to overturn the order directing him to defend himself. In Appeal No. CA/LAG/CR/1244/2019, he asked the appellate court to set aside the decision. The appeal was eventually dismissed, and he was directed to return to the trial court for the continuation of the case.
Nwude later began his defence on February 22, 2021, testifying personally and calling three witnesses before closing his case. His co-defendants, Ilechukwu and Kalu, who had represented him during parts of the legal proceedings, also testified in their own defence and concluded their case on February 27, 2025.
Following the close of the defence, the court ordered both parties to file their final written addresses and initially adjourned the matter to June 25, 2025. When the case resumed on that date, it was further adjourned to September 25, 2025.
At the resumed hearing, the Director of the Directorate of Public Prosecutions in Lagos State, Babajide Martins, appeared before the court and informed the judge that he had been instructed to take over the prosecution of the case. Martins explained that his office had received a petition from the second defendant, Ilechukwu, which led to the directive.
Justice Dada, however, questioned the timing of the move, noting that the case had already reached the stage of adopting final written addresses. She asked why the DPP sought to take over a matter that was nearly concluded, but Martins was unable to provide a clear explanation.
The court subsequently adjourned the matter to November 5, 2025, to allow the first defendant’s counsel to file a reply on points of law to the prosecution’s final address before adoption.
After reviewing the arguments from both sides and examining the evidence presented during the lengthy trial, the court ultimately convicted the three defendants and sentenced each of them to one year in prison.
