EFCC Seeks Disqualification Of Judge From Terrorism Case.

The Economic and Financial Crimes Commission (EFCC) has petitioned the Chief Judge of the Federal High Court, Justice John Tsoho, requesting the recusal of Justice Mohammed Umar from a terrorism financing case at the Abuja Division of the court.....KINDLY READ THE FULL STORY HERE▶

In its petition, the anti-graft agency said it no longer trusts Justice Umar to handle the case impartially and asked that the matter, marked FHC/ABJ/CR/705/2025, be reassigned.

The charge is pending against Bauchi State Commissioner for Finance, Yakubu Adamu, and three others over alleged terrorism financing.

Adamu, a former Polaris Bank Plc branch manager in Bauchi, was arraigned on December 31, 2025, alongside Balarabe Abdullahi Ilelah, Aminu Mohammed Bose, and Kabiru Yahaya Mohammed, all civil servants.

They face a 10-count charge involving conspiracy, misappropriation of public funds, and alleged terrorism financing under Sections 2(1) and 19(1)(d) of the Money Laundering (Prevention and Prohibition) Act, 2022, punishable under Section 19(2)(b).

The EFCC alleged the defendants executed cash transactions totaling around $9.7 million without using formal banking channels. Between January and May 2024, Adamu, in collaboration with Bauchi State Accountant-General Sirajo Jaja, Samaila Irmiya Liman, and the other defendants, allegedly handed $2.3 million in cash to Bello Bodejo and associates.

Bodejo, president of Miyetti Allah Kautal Hore, was previously arrested and charged with terrorism-related offences for allegedly forming an ethnic militia in Nasarawa State; the charge was later withdrawn in May 2024.

The EFCC stated that the defendants had reasonable grounds to suspect the funds would be used for terrorist activities, noting that some suspects, including the Bauchi State Accountant-General, remain at large.

The petition also highlighted that Justice Umar granted the defendants bail despite the serious allegations and a counter-affidavit requesting continued detention. Previously, Justice Emeka Nwite, who initially presided over the case, had denied bail and remanded the defendants at Kuje Correctional Centre on January 5, 2026.

After the case was reassigned, Justice Umar admitted the defendants to bail on January 21, setting N100 million each with two sureties in like sum. The court also ordered them to surrender international passports, barred travel without permission, and required weekly reporting to the Bauchi office of the Department of State Services. The judge rejected EFCC’s claim that the defendants were flight risks.

On Thursday, Justice Umar announced he would temporarily step aside to await the Chief Judge’s ruling on the EFCC’s petition. Despite attempts by defence counsel Chief Chris Uche (SAN) to continue the trial, the judge declined, citing the decision as being “in the interest of justice,” and adjourned the case sine die.

What more can we say but thank you? You have done your part; we will now do ours. Abaji people have spoken, and they spoke decisively,” he said.
