“El-Rufai Fights Back, Seeks ₦2 Billion As He Moves To Quash DSS Case”.

Published

Former Kaduna State Governor, Nasir El-Rufai, has approached the Federal High Court in Abuja, seeking the dismissal of criminal charges filed against him by the Department of State Services (DSS).....KINDLY READ THE FULL STORY HERE▶

El-Rufai described the charges as incompetent, unconstitutional, and a misuse of the judicial process.

The motion challenges Charge No. FHC/ABJ/CR/99/2026, dated February 16, 2026, which is scheduled for hearing on February 25 before Justice Joyce Abdulmalik.

In his application, El-Rufai is asking the court to strike out or quash the charge on the grounds that it discloses no offence recognized by law and fails to establish a prima facie case. He further urged the court to discharge him entirely.

The former governor is also seeking ₦2 billion in costs against the DSS, accusing the agency of weaponizing the criminal justice system to harass, embarrass, and publicly victimise him.

Court documents indicate that El-Rufai’s motion outlines 17 grounds for dismissing the charges.

His legal team reportedly notified the Director-General of the DSS of the application in a letter dated February 18, providing details of his legal representatives.

Among the grounds cited are alleged constitutional invalidity, failure to establish a prima facie case, references to offences not recognized by law, lack of prosecutorial competence, duplicity of charges, absence of evidence, bad faith, political persecution, and abuse of court process.

El-Rufai also argued that the prosecution infringes on his fundamental rights under the 1999 Constitution (as amended), including the presumption of innocence and protection against self-incrimination.

He further claimed violations of constitutional provisions requiring that offences be clearly defined in written law, as well as breaches of his rights to freedom of expression and association.

The application was signed by his media adviser, Muyiwa Adekeye, and dated February 24, 2026.

The court is expected to hear arguments on the motion when the matter comes up on February 25.
