Alhaja Kudirat Abiola, wife of the late businessman and politician MKO Abiola—widely regarded as the winner of the annulled June 12, 1993 presidential election—was assassinated in Lagos on June 4, 1996, during the political turmoil that followed the annulment and her campaign for the restoration of her husband’s mandate.

In a unanimous decision delivered by a five-member panel led by Justice Uwani Aba-Aji, the apex court ruled that Lagos State had abandoned its appeal seeking to reopen Al-Mustapha’s trial.

When the case was called, Al-Mustapha’s counsel, Paul Daudu (SAN), told the court that although the Supreme Court granted Lagos State leave in 2014 to challenge the acquittal, the state failed to file a notice of appeal or take any steps to prosecute the matter. He noted that Lagos was given 30 days to file its appeal but had taken no action for over nine years, urging the court to dismiss the case for lack of diligent prosecution.

Justice Aba-Aji confirmed that Lagos State was properly served with hearing notices but neither appeared in court nor filed any processes.

In its ruling, the Supreme Court held that the prolonged inaction showed the state had lost interest in the case. Justice Aba-Aji described the failure to act within nine years as inexcusable and criticised Lagos State for not offering any explanation, noting that the conduct amounted to an abuse of court process.

Consequently, the appeal marked SC/CR/45/2014 was dismissed. A related appeal, SC/CR/6/2014, filed by the Lagos State Government, was also struck out on similar grounds.

In 2014, the Supreme Court had granted Lagos State permission to challenge the July 12, 2013 judgment of the Court of Appeal, which discharged and acquitted Al-Mustapha of Kudirat Abiola’s murder. The appellate court, in a unanimous ruling by Justices Amina Augie, Rita Pemu, and Fatimo Akinbami, held that the prosecution failed to establish sufficient evidence to sustain the conviction.

That verdict overturned the January 30, 2012 judgment of the Lagos High Court, presided over by Justice Mojisola Dada, which sentenced Al-Mustapha, Mohammed Abacha, and Lateef Shofolahan to death by hanging for conspiracy and murder.

Lagos State had sought to reinstate the death sentence, arguing that both direct and circumstantial evidence linked Al-Mustapha to the crime. However, with Thursday’s ruling, the Supreme Court has effectively ended all attempts by the state to revive the case.
