KWAM 1 Backs Down, Withdraws Court Suit Over New Awujale Installation.

According to Nivo News, the withdrawal was conveyed through a notice of discontinuance signed by his legal counsel, Wahab Shittu (SAN), informing the court of his client’s decision to discontinue the suit aimed at stopping the traditional succession process.

In the notice, the claimant stated that the suit was withdrawn pursuant to the relevant provisions of the Ogun State High Court Civil Procedure Rules 2024 and under the inherent jurisdiction of the court. The document explained that the action was initially instituted following correspondence from the second respondent dated December 2, 2025, which has since been withdrawn, rendering the case unnecessary.

The applicant subsequently urged the court to formally record the discontinuance and make any orders it deemed appropriate in the circumstances.

Recall that earlier in the week, Justice A. A. Omoniyi of Court 3, Ijebu-Ode Judicial Division, declined to grant an ex parte application filed by KWAM 1 seeking an interim injunction to suspend the installation process of the new Awujale.

The court ruled that the application lacked merit, noting that interim reliefs must be accompanied by a substantive motion on notice, in line with established Supreme Court precedents. The judge further cited Order 39 Rule 2, which prohibits the grant of ex parte injunctions without a corresponding motion on notice.

Justice Omoniyi also observed that the applicant failed to provide an undertaking as to damages, a requirement the court described as fundamental in injunction applications. On these grounds, the court dismissed the application in its entirety.
