Supreme Court Upholds SDP By-Election Victory, Dismisses INEC Appeal.

According to Nivo News, the apex court affirmed earlier judgments requiring INEC to recognise and include SDP candidates in by-elections held across 12 states. The decision follows INEC’s challenge to the October 17, 2025, Court of Appeal ruling, which itself had upheld a Federal High Court order directing the electoral body to list SDP candidates on the ballot.
INEC argued that letters and notices submitted by the SDP’s Acting National Chairman, Dr Sadiq Umar Abubakar, and National Secretary, Dr Olu Agunloye, were invalid due to their suspension by the party. The Commission maintained that this rendered all candidate nominations submitted by the officials null and void.
The Federal High Court, however, had ordered INEC to recognise the SDP candidates, a directive the Commission initially complied with but later challenged at the Court of Appeal. The appellate court dismissed INEC’s appeal, and the Supreme Court has now also rejected the electoral body’s final appeal, ruling that the matter had become academic since the elections had been conducted and winners sworn in.
Delivering the lead judgement, Justice Mohammed Idris noted that there was no live issue left for adjudication, emphasising that courts do not intervene in academic questions. In addition to dismissing the appeal, the Supreme Court imposed a ₦2 million cost against INEC’s legal team.

A Delta State High Court has handed down death sentences to two individuals for their involvement in the 2018 killing of Delta State University (DELSU) undergraduate Elozino Ogege, following a ruling that found them guilty. Meanwhile, a third co-defendant facing charges related to the same incident was discharged and acquitted. In separate releases on Wednesday, the opposition party and its 2027 gubernatorial hopeful, Michael Aondoakaa, slammed Governor Alia, alleging a lack of effective leadership and an inability to safeguard citizens. Conversely, the governor hit back, claiming that the opposition is cynically capitalizing on a security disaster for political mileage.
Speaking through its Publicity Secretary, Bright Antyo, the PDP condemned the administration’s sluggish reaction to ongoing violence. The party asserted that true leadership requires decisive action and empathy rather than empty words—qualities they claim are missing under the current administration.
Aondoakaa further charged that the state government is prioritizing the suppression of dissent over tackling the root causes of insecurity. He lamented that communities remain vulnerable to constant invasions and farmer displacements, yet officials treat public criticism as a graver threat than the attackers themselves, noting that the bloodshed persists despite government denials.
In his defense, Governor Alia, via his Chief Press Secretary Tersoo Kula, argued that the crisis demands collective compassion and unity instead of partisan assaults. The governor emphasized that his administration remains deeply committed to tackling insecurity by providing security agencies with robust logistics, intelligence support, personnel motivation, and collaboration with local vigilante networks to restore lasting peace.
