Shock In Court As FG Defends Terrorist Label On Mamu Before Judgment.

Mamu, through his counsel, Johnson Usman (SAN), told Justice Mohammed Umar of the Federal High Court in Abuja that the AGF’s action contravened Section 36(5) of the 1999 Constitution, which guarantees the presumption of innocence for anyone standing trial. Usman said several media publications that branded Mamu a terrorist had been submitted in court as evidence, arguing that such reports were prejudicial and unconstitutional.
He urged the court to safeguard his client’s rights, stating that although Mamu is already facing terrorism charges, it was improper for the government to make a unilateral declaration labelling him a terrorist without a court judgment. Usman added that they wrote to the AGF requesting a reversal of the designation, but the request was ignored.
The senior lawyer described the Federal Government’s counter-affidavit as an admission that the designation was made while the trial was ongoing. He maintained that it was legally and morally indefensible to assign such a label before conviction, insisting that only a competent court can make such a declaration. According to him, the government’s action has caused significant harm, deserving of damages “to teach them a lesson.”
In opposition, counsel to the AGF, David Kaswe, defended the government’s stance, arguing that the AGF acted within the powers granted under Sections 49 and 50 of the Terrorism Prevention and Prohibition Act, 2022. He explained that the Sanction Committee is responsible for recommending individuals for terrorist designation, adding that the AGF merely acted on its recommendations.
Justice Umar questioned whether the law permits the government to designate an individual as a terrorist before the conclusion of their trial. He asked what would happen if the court eventually finds Mamu not guilty. Kaswe responded that the Sanction Committee meets quarterly and can review or withdraw such designations, noting that a “designated terrorist” differs from a “convicted terrorist.”
Usman countered that the Terrorism Act cannot supersede the Constitution, stressing that the charges against Mamu were filed in 2023, long before his designation in 2024. He insisted that Section 36(5) clearly protects Mamu until proven guilty, adding that the Federal Government’s interpretation of Section 49 was flawed.
Justice Umar directed both sides to file additional written addresses comparing Section 36 of the Constitution with Section 49 of the Terrorism Prevention Act. The case was adjourned to February 23, 2026, for adoption of final written arguments.
