INEC Challenges State Court Jurisdiction In PDP Convention Case.

According to Nivo News, the Oyo State High Court in Ibadan has adjourned ruling on a preliminary objection challenging its jurisdiction in a case seeking to halt the Peoples Democratic Party (PDP) national convention scheduled for November 15 and 16, 2025.....KINDLY READ THE FULL STORY HERE▶

The lawsuit was filed by PDP member Folahan Adelabi, who is contesting attempts to interfere with the convention’s preparations. At Friday’s hearing, counsel for the Independent National Electoral Commission (INEC), O. Adeyemi, argued that the State High Court lacked jurisdiction because INEC, as a federal agency, is accountable only to the Federal High Court. Adeyemi urged the court to dismiss the case, stating, “INEC is a federal agency and falls strictly under the jurisdiction of the Federal High Court. This court cannot entertain this matter.”

However, the claimant’s counsel, Musibau Adetumbi, SAN, opposed the objection, asserting that it infringed on the claimant’s fundamental rights. He emphasized that the 1999 Constitution guarantees the right of association and peaceful assembly, including political conventions, and cited Section 251 to argue that INEC does not automatically fall outside the State High Court’s jurisdiction.

After hearing arguments from both sides, Justice Ladiran Akintola adjourned ruling on the objection to December 8, 2025, while reaffirming that the interim injunction restraining the defendants from interfering with the PDP convention remains in effect.

The defendants named in the suit include the PDP, its Acting National Chairman Umar Damagum, Adamawa State Governor Ahmadu Fintiri as Chairman of the Convention Organising Committee, and INEC.
