Reports indicate that the move has ignited fresh controversy within the Red Chamber, as insiders told Sahara Reporters that the appeal was not approved by the Senate collectively but was allegedly a unilateral decision of Senate President Godswill Akpabio.

On July 4, 2025, Justice B.F.M. Nyako of the Federal High Court, Abuja, ruled in Senator Akpoti‑Uduaghan’s favour, declaring her suspension “unconstitutional and unlawful.”

In Suit No. FHC/ABJ/CS/384/2025, the court held that the suspension violated the Constitution and effectively deprived the people of Kogi Central of proper representation.

“The suspension was unduly excessive. It infringed on the rights of the constituents and amounts to a denial of representation,” Justice Nyako stated, urging the Senate to review its internal sanction mechanisms.

Dissatisfied with the ruling, the Senate’s legal team—comprising Chikaosolu Ojukwu (SAN), Paul Babatunde Daudu (SAN), Gbenga Makonjuola (Esq.), and Monday Adjeh (Esq.)—filed a cross‑appeal on July 24, 2025, citing three grounds of appeal and seeking three reliefs.

A key contention in the appeal is that the trial court allegedly erred by entertaining the suit without a pre‑action notice, as required under Section 21 of the Legislative Houses (Powers and Privileges) Act, 2017. The Senate argues that Senator Akpoti‑Uduaghan failed to serve the mandatory notice to the Clerk of the Senate before initiating the case, insisting that the requirement applies to all citizens, including serving lawmakers.

Among the reliefs sought are:

  • An order allowing the cross‑appeal,

  • An order striking out the suit for lack of jurisdiction, and

  • Any other order deemed appropriate by the Court of Appeal.

However, a serving senator who spoke anonymously with Sahara Reporters disputed the legitimacy of the appeal, insisting there was no Senate resolution authorizing it.

“It should be noted that this action of appeal wasn’t consented to by the Senate; there was no resolution to that effect,” the source said.

According to the senator, Akpabio personally directed the Clerk of the Senate to file the appeal without consulting the Senate leadership or conducting a formal vote.

This move has reportedly deepened tensions between Akpabio and Senate Leader Opeyemi Bamidele.

During a closed‑door session on Wednesday, Bamidele was said to have confronted Akpabio, accusing him of sidelining other leaders in critical decisions.

“Senator Opeyemi has threatened to resign his leadership position if Akpabio continues to act autocratically,” the source added.

The lawmaker also warned that the ongoing conflict between Akpoti‑Uduaghan and Akpabio is damaging public confidence in the Senate’s integrity.
