The Case Must Go On!’ – FG Moves to Crush Nnamdi Kanu’s No‑Case Argument

The Federal Government on Friday urged the Federal High Court in Abuja to dismiss the no‑case submission filed by detained IPOB leader, Nnamdi Kanu.....KINDLY READ THE FULL STORY HERE▶

Lead counsel for the government, Adegboyega Awomolo, SAN, made the request while responding to Kanu’s application before Justice James Omotosho.

Awomolo told the court that Kanu, in a broadcast on Radio Biafra, openly declared his intention to dismember Nigeria and establish a Republic of Biafra. He argued that these were not empty threats but deliberate incitements that instilled widespread fear among citizens.

According to Awomolo, Kanu’s broadcast went further by allegedly directing followers to attack and kill policemen and their families—claims linked to the deaths of over 170 security personnel. He added that Kanu proudly identified himself as IPOB’s leader despite the group’s proscription, vowing that “the world would come to a standstill.”

“The law prohibits statements capable of keeping citizens in perpetual fear. Kanu’s threats were not idle—they were aimed at disintegrating Nigeria, and such acts carry consequences,” Awomolo said.

He urged the court to reject the no‑case submission, insisting that Kanu must open his defence on the seven‑count terrorism charge filed by the Office of the Attorney‑General of the Federation.

However, Kanu’s lead counsel, Chief Kanu Agabi, SAN, argued that the prosecution had failed to establish any case. He noted that none of the witnesses testified that Kanu incited them to violence, and that all five prosecution witnesses—DSS operatives—merely admitted to taking his statements without conducting any further investigation or presenting investigative reports.

Agabi also pointed out that despite the charges being amended eight times, no witness claimed to have been incited by Kanu. He contended that Kanu’s statements, including his threat to “bring the world down,” amounted to nothing more than boastful rhetoric, and that his calls for self‑defence were consistent with constitutional rights—a position echoed by prominent figures such as retired General T.Y. Danjuma.

Agabi further criticised Kanu’s prolonged solitary confinement over the last decade, arguing that international law prohibits such detention beyond 15 days. He maintained that the elements of terrorism had not been proven and urged the court to discharge and acquit his client.

After hearing both sides, Justice Omotosho adjourned the matter to October 10 for ruling on the no‑case submission.

According to him, the practice has continued to degrade road infrastructure, complicate maintenance efforts, and disrupt traffic movement in affected communities.

In a related development, the House of Assembly also adopted a report from its Committee on Lands and Housing on the Ministry of Physical Planning and Urban Development’s revised regulations aimed at strengthening planning and development control across the state.

The approved regulations include the Ogun State Building Production Management Regulation 2025, Planning and Development Permit Regulation 2025, Slum Regeneration Regulation 2025, Outdoor Physical Furniture Regulation 2025, and Layout and Land Subdivision Regulation 2025.

The resolution followed the presentation of the committee report by Chairman Damilola Soneye, seconded by Lukman Adeleye, and unanimously adopted by lawmakers through a voice vote after a motion moved by the House Leader, Yusuf Sheriff.

Following the adoption, the Speaker directed that the resolution be forwarded to all relevant authorities for implementation.

The assurance was given on Tuesday by the newly deployed Resident Electoral Commissioner (REC), Oluwatoyin Babalola, while addressing protesters at the commission’s office in Osogbo.

The protesters, made up of market women and civil society groups, had gathered to express concerns over the recent redeployment of the former REC, Mutiu Agboke, which they feared could affect the credibility of the upcoming election.

Speaking through the Head of Legal Department, Niyi Fayanju, and the Head of Voter Education and Publicity, Rufus Ariyo, Babalola assured them that adequate measures had been put in place to ensure a free, fair, and conclusive election.

She acknowledged the concerns of residents, describing them as valid, and promised that INEC would uphold electoral integrity while ensuring that every valid vote is properly counted.

Babalola also explained that staff redeployments are normal administrative procedures, adding that the transfer of the former REC was carried out in line with established civil service rules.

However, some protesters expressed suspicion that the transfer may have been politically motivated, urging the new REC to remain impartial in the discharge of her duties.

The Osun State Chairman of the Coalition of Concerned Nigerian Citizens (CCNC), Mr. Musa Abdulsalam, also submitted a formal petition to INEC officials on behalf of the protesters.

According to a statement released by the Economic and Financial Crimes Commission (EFCC), the case is before Justice James Omotosho, with Bello standing trial alongside Dauda Sulaiman over allegations of misappropriation and money laundering involving more than ₦10 billion.

He urged the court not to grant the adjournment, describing the request as premature and not formally filed.
