The Case Must Go On!’ – FG Moves to Crush Nnamdi Kanu’s No‑Case Argument

The Federal Government on Friday urged the Federal High Court in Abuja to dismiss the no‑case submission filed by detained IPOB leader, Nnamdi Kanu.....KINDLY READ THE FULL STORY HERE▶

Lead counsel for the government, Adegboyega Awomolo, SAN, made the request while responding to Kanu’s application before Justice James Omotosho.

Awomolo told the court that Kanu, in a broadcast on Radio Biafra, openly declared his intention to dismember Nigeria and establish a Republic of Biafra. He argued that these were not empty threats but deliberate incitements that instilled widespread fear among citizens.

According to Awomolo, Kanu’s broadcast went further by allegedly directing followers to attack and kill policemen and their families—claims linked to the deaths of over 170 security personnel. He added that Kanu proudly identified himself as IPOB’s leader despite the group’s proscription, vowing that “the world would come to a standstill.”

“The law prohibits statements capable of keeping citizens in perpetual fear. Kanu’s threats were not idle—they were aimed at disintegrating Nigeria, and such acts carry consequences,” Awomolo said.

He urged the court to reject the no‑case submission, insisting that Kanu must open his defence on the seven‑count terrorism charge filed by the Office of the Attorney‑General of the Federation.

However, Kanu’s lead counsel, Chief Kanu Agabi, SAN, argued that the prosecution had failed to establish any case. He noted that none of the witnesses testified that Kanu incited them to violence, and that all five prosecution witnesses—DSS operatives—merely admitted to taking his statements without conducting any further investigation or presenting investigative reports.

Agabi also pointed out that despite the charges being amended eight times, no witness claimed to have been incited by Kanu. He contended that Kanu’s statements, including his threat to “bring the world down,” amounted to nothing more than boastful rhetoric, and that his calls for self‑defence were consistent with constitutional rights—a position echoed by prominent figures such as retired General T.Y. Danjuma.

Agabi further criticised Kanu’s prolonged solitary confinement over the last decade, arguing that international law prohibits such detention beyond 15 days. He maintained that the elements of terrorism had not been proven and urged the court to discharge and acquit his client.

After hearing both sides, Justice Omotosho adjourned the matter to October 10 for ruling on the no‑case submission.

reports that the announcement was made on Tuesday in Calabar by the Commissioner for Health, Henry Ayuk, during a press briefing.

Ayuk disclosed that the index case involves a 53-year-old Chinese national employed by Lafarge in Akamkpa Local Government Area. He explained that the individual arrived in Nigeria on March 17 and later began showing symptoms associated with COVID-19.

According to the commissioner, the patient’s condition worsened while receiving care at a government facility, leading to his transfer to the University of Calabar Teaching Hospital for advanced treatment.

At the teaching hospital, samples were taken and all necessary protocols observed, after which the infection was confirmed. Ayuk, however, noted that the patient is responding well to treatment.

He stressed that the state’s healthcare system is adequately prepared to manage such cases, urging residents not to panic as surveillance and containment strategies are already in effect.

Also speaking, the State Epidemiologist, Inyang Ekpenyong, said the emergency response system has been activated, with contact tracing and identification of possible contacts already ongoing.

She revealed that rapid response teams have been deployed to Akamkpa, where the patient works, to monitor the situation closely.

On her part, the World Health Organisation’s State Coordinator, Yewande Olatunde, reiterated that COVID-19 remains a public health concern and urged continued adherence to preventive measures.
