The Socio-Economic Rights and Accountability Project (SERAP) has demanded the immediate reinstatement of Senator Natasha Akpoti-Uduaghan following a Federal High Court ruling that nullified her six-month suspension from the National Assembly.....KINDLY READ THE FULL STORY HERE▶

According to NIVONEWS, SERAP, in a statement posted via its official handle on Tuesday, described the suspension as a “grave violation” of both the Nigerian Constitution and international human rights obligations, urging Senate President Godswill Akpabio to respect the court’s ruling without delay.

“Senate President Godswill Akpabio must immediately obey the court order and ensure a smooth return of Senator Natasha Akpoti-Uduaghan to the Senate today or any other day of her choosing,” the group stated.

SERAP further slammed the Senate’s original action, insisting that the lawmaker’s suspension was not only unconstitutional but unjustified and an affront to democratic values.

“She should never have been suspended in the first place. Her suspension is a grave violation of the Nigerian Constitution 1999 [as amended] and international human rights treaties to which Nigeria is a signatory,” SERAP added.

The group urged the Senate leadership not only to reinstate Senator Akpoti-Uduaghan immediately but also to restore her full legislative rights, entitlements, and privileges.

Recall that the Federal High Court sitting in Abuja, presided over by Justice Binta Nyako, ruled on Friday that the Senate’s action against the Kogi Central senator was excessive, unconstitutional, and a breach of her rights as an elected official.

The court held that Chapter 8 of the Senate Standing Rules and Section 14 of the Legislative Houses (Powers and Privileges) Act failed to provide clear limits for the duration of suspensions, thus rendering the six-month sanction disproportionate and unlawful.

Justice Nyako noted that with only 181 sitting days in a legislative year, a six-month suspension effectively disenfranchised the people of Kogi Central by barring their representative from performing her duties for the majority of the session.

While acknowledging the Senate’s right to discipline its members, the court stressed that such measures must not go so far as to deny constituents their right to representation.

SERAP concluded by calling on the Senate to lead by example by complying fully with the court’s judgment, in order to uphold democratic principles and the rule of law in Nigeria.
