‘They Attacked Me!’ Immigration Officer Takes NIS Board to Court Over Harassment, Obstruction

The suit, now before the National Industrial Court, Abuja Division, stems from a July 2019 incident in which Dr. Badiru was allegedly assaulted by a colleague, Assistant Comptroller of Immigration Umar Nasir Mohammed, at the VIP Issuance Unit of the Ikoyi Passport Office while carrying out his official duties.

According to court documents, Badiru sustained serious injuries during the attack and was reportedly abandoned by superiors, requiring emergency treatment at the Military Hospital in Ikoyi, Lagos. After lodging a complaint with the police and undergoing medical evaluation, he claimed he returned to work only to be arrested and detained by NIS operatives.

Despite being cleared by an internal investigation panel, Dr. Badiru said he was subjected to an unlawful disciplinary process. Instead of receiving protection as a victim of workplace violence, he alleged he was transferred from Lagos to Abuja and targeted for dismissal. Meanwhile, the officer accused of attacking him allegedly received successive promotions.

After years of stalled promotions and worsening health conditions, Dr. Badiru approached the National Industrial Court in 2023 (Suit No: NICN/ABJ/136/2023). The court ruled in his favour, declared the disciplinary measures illegal, and ordered the NIS to immediately promote him to a rank equivalent to his peers—or higher—and allow him to participate in the 2024 promotion exams. The court also awarded ₦1.2 million in damages for violation of his fundamental rights.

However, despite passing the promotion examination, Badiru said the NIS refused to effect his promotion. In a letter dated September 20, 2024, the agency allegedly told the promotion board to hold back his advancement unless he withdrew all legal cases related to the matter—despite no active disciplinary action against him.

Dr. Badiru’s criminal complaint accuses the officials of deliberately flouting court orders and obstructing justice, citing violations of Sections 126(1) and 516 of the Criminal Code Act. He said their actions undermine the judiciary and set a dangerous precedent for other officers seeking redress within the system.

He has asked the court to summon the accused to face the charges, stating that his case is filed in good faith and in pursuit of justice.

The matter has been adjourned to November 6, 2025, for arraignment and hearing.

The Bangbola Oyewo family of the Ese-Ola Royal House remembered him as a beloved family man, traditional leader, and an inspiration to generations of theatre practitioners. His passing is regarded as the end of an era for the Nigerian theatre community, where he served as an Associate Professor of Drama and a long-standing mentor.
