Court Orders Nigerian Government to Serve Documents to Nnamdi Kanu Before Trial
The Federal High Court in Abuja has ordered the Federal Government to provide Nnamdi Kanu, the leader of the Biafra separatist movement, with all documents and materials intended for submission as exhibits in his ongoing trial. The ruling, delivered by Justice James Omotosho on May 6, 2025, stressed that all relevant documents must be shared with Kanu in advance, as mandated by law. The order came after an issue arose during Kanu’s trial when the second prosecution witness, known as PW2, attempted to present a document without it being properly disclosed beforehand. Kanu’s lawyer, Kanu Agabi, opposed the admission of this document on the grounds of non-compliance with legal procedures, leading to its eventual withdrawal.
Further discussions in the trial revealed a discrepancy when PW1, a Department of State Service (DSS) operative, admitted to being unaware that several of the charges against Kanu had been dismissed by the court. Additionally, the court emphasized that no document or evidence would be admitted unless it had been properly disclosed to the defense prior to the trial.
The trial is scheduled to continue on May 7, 2025, with the focus on ensuring that all legal protocols are followed to guarantee a fair trial for Kanu.
