WhatsApp Warns of Service Disruption in Nigeria Over $220m FCCPC Penalty
WhatsApp LLC has stated that its operations in Nigeria could be severely impacted following the recent judgment by the Competition and Consumer Protection Tribunal, which upheld the Federal Competition and Consumer Protection Commission’s (FCCPC) authority to sanction the messaging platform and its parent company, Meta Platforms Inc., for anti-competitive conduct. “WhatsApp relies on minimal data to function and ensure user safety. Operating without Meta’s infrastructure would be impossible, whether in Nigeria or worldwide. The FCCPC’s ruling contains significant inaccuracies about how WhatsApp operates. We are urgently filing an appeal and applying to stay the order to protect our users,” the platform said.
The tribunal, chaired by Hon. Thomas Okosun, delivered a decisive ruling affirming the FCCPC’s authority across most issues contested by Meta and WhatsApp. It endorsed the FCCPC’s final order of July 19, 2024, imposing a $220 million administrative penalty on the tech firms, along with $35,000 to cover investigative costs.
This ruling follows a sweeping 38-month joint investigation launched in 2020 by the FCCPC and the Nigeria Data Protection Commission (NDPC) into Meta and WhatsApp’s data privacy and consumer protection practices.
Dissatisfied with the commission’s conclusions, Meta and WhatsApp appealed, questioning the FCCPC’s jurisdiction, investigative approach, and findings. However, the tribunal dismissed their objections, affirming that the FCCPC operated within the framework of the 1999 Constitution (as amended) and the Federal Competition and Consumer Protection Act (FCCPA).
A central issue — whether the FCCPC could regulate matters related to data privacy — was resolved in the commission’s favor. The tribunal reinforced that the FCCPC’s consumer protection mandate extends into areas like data privacy, under Section 104 of the FCCPA.
While the tribunal upheld most of the FCCPC’s conclusions, it struck out one element (Order 7) from the commission’s final order, citing insufficient legal grounding.
Reacting to the ruling, FCCPC executive vice chairman/CEO, Mr. Tunji Bello, hailed the judgment as a major milestone in Nigeria’s regulatory advancement. He praised the commission’s legal team for their skill and dedication and reiterated the agency’s commitment to protecting consumer rights and ensuring fair market practices, aligning with President Bola Tinubu’s Renewed Hope Agenda.
Despite signaling its intent to contest the judgment, WhatsApp assured users of its dedication to continuing operations in Nigeria. However, it cautioned that compliance with the current FCCPC directive without access to Meta’s support could significantly disrupt services.
The stage is now set for an extended legal confrontation that could reshape regulatory engagement with global tech companies in Nigeria.
