Falana: Ibas Has No Right to Attend NEC, Tinubu Must Act Now
Renowned human rights lawyer and Senior Advocate of Nigeria (SAN), Femi Falana, has declared that Vice Admiral Ibok-Ete Ibas (retd.), the Sole Administrator appointed in Rivers State, lacks the legal authority to participate in the National Economic Council (NEC) meeting held at the Presidential Villa in Abuja.....KINDLY READ THE FULL STORY HERE▶
Falana, who spoke during the 70th birthday lecture of Dr. Osagie Obayuwana, stated that the NEC is constitutionally made up of the Vice President (as Chairman), all state governors, and the Governor of the Central Bank of Nigeria (CBN) — as stipulated by the CBN Act. Therefore, he argued, Ibas’ attendance at the meeting constitutes a serious constitutional violation.
He further urged President Bola Tinubu to immediately caution the Sole Administrator against attending any future NEC or other federal executive meetings, stressing that such actions breach the Nigerian Constitution.
Responding to a recent statement credited to Ibas — that the people of Rivers State are “testing his will” and that he was granted “sweeping powers” by a government gazette — Falana debunked the claim. He clarified that the gazette in question only permits the Sole Administrator to operate under specific regulations from President Tinubu, which have yet to be issued. Therefore, he insisted, all actions taken by Ibas thus far are unlawful and unconstitutional.
“The appointment should be revoked without delay,” Falana stated emphatically.
In a related matter, Falana also condemned the executive order issued by Niger State Governor Umaru Bago, which mandates the arrest and forced shaving of individuals with dreadlocks. The human rights lawyer labelled the directive unconstitutional, citing the legal precedent in FAITH OKAFOR v. GOVERNOR OF LAGOS STATE where the Court of Appeal ruled that executive orders cannot create offences not codified in law.
Falana maintained that both at state and federal levels, such arbitrary orders lack legal backing and must be challenged to preserve the rule of law.
