Supreme Court to Hear PDP Governors’ Challenge to Rivers Emergency Declaration Post-Easter

The Supreme Court of Nigeria is set to deliberate on a legal challenge brought by 11 governors from the Peoples Democratic Party (PDP), opposing the declaration of a state of emergency in Rivers State by President Bola Ahmed Tinubu.....KINDLY READ THE FULL STORY HERE▶

The court will fix a hearing date after its Easter recess. Confirming the development, Festus Akande, Director of Information and Public Relations at the Supreme Court, said, “The court is currently on vacation, but a date will be scheduled once the Justices return by the end of the month.”

The central issue of the lawsuit is the constitutional validity of President Tinubu’s decision to suspend a democratically elected state government and install a Sole Administrator to manage the affairs of Rivers State.

Filed under case number SC/CV/329/2025, the suit questions the President’s authority to suspend Governor Siminalayi Fubara, Deputy Governor Ngozi Odu, and the entire House of Assembly for a six-month period—a move made public on March 18, 2025. President Tinubu also appointed retired Vice Admiral Ibok-Ete Ibas as the interim Sole Administrator for the state.

The PDP-led states pursuing the case are: Adamawa, Enugu, Osun, Oyo, Bauchi, Akwa Ibom, Plateau, Delta, Taraba, Zamfara, and Bayelsa. The governors are urging the apex court to clarify whether Sections 1(2), 5(2), 176, 180, 188, and 305 of the 1999 Constitution give the President any legal backing to override elected state officials and install an unelected appointee under the guise of a state of emergency.

Additionally, the suit raises alarm over alleged threats from the Presidency—communicated through the Attorney General—to extend similar suspensions to other state governors and their deputies. The PDP governors argue such actions are unconstitutional and undermine the principles of federalism and democratic governance.

This legal battle is poised to set a precedent for federal-state relations and constitutional interpretation in Nigeria, as political tensions in Rivers State remain under national scrutiny.
