Rivers Crisis: Tinubu’s State of Emergency Defused Potential Violence, Lawyer Says

Dike affirmed that the president’s decision was in full compliance with Section 305 of the 1999 Nigerian Constitution (as amended). He highlighted that Section 14, Subsection 2 of the constitution assigns the government the crucial responsibility of safeguarding lives and property, a duty which, according to Dike, President Tinubu effectively fulfilled in Rivers State.

Speaking to journalists in Port Harcourt on Wednesday, Dike warned that public safety would have been severely compromised if Governor Siminalayi Fubara had been impeached by the House of Assembly. He also pointed out the growing threats from certain groups and individuals from a particular ethnic group, which jeopardized the safety of non-indigenes in the state and endangered critical federal infrastructure.

Dike expressed concern that these threats could have had serious ramifications beyond Rivers, potentially igniting unrest in other parts of the country. He criticized Governor Fubara for failing to publicly denounce these threats or direct security forces to take action against those responsible.

Additionally, Dike took issue with Governor Fubara’s comments following the Supreme Court ruling, where he reassured youth that he would advise them at the appropriate time, failing to provide strong leadership in the face of mounting tension.

Dike argued that President Tinubu’s declaration of emergency was a necessary measure to prevent the complete breakdown of law and order, calling it a prudent and timely intervention. He also pointed out that such actions were not unprecedented, citing previous instances where former Presidents Olusegun Obasanjo and Goodluck Jonathan had declared states of emergency in other Nigerian states.

He concluded by questioning why Rivers’ situation should be politicized along ethnic lines, reminding the public that similar actions had been taken in other states without controversy
