In defense of the state of emergency, Morka stated that President Tinubu acted within the provisions of Section 305 of the Nigerian Constitution, which permits the President to declare a state of emergency in cases of national security threats. He noted that intelligence reports indicated growing security risks in Rivers, including threats to critical oil infrastructure, particularly after the Trans Niger Pipeline (TNP) was reportedly vandalized.
Morka also clarified that the declaration was not a unilateral decision, as it was ratified by a two-thirds majority in the National Assembly, which is a multi-partisan body. He emphasized that representatives from various political parties came together to approve the declaration after reviewing all available information.
