According to NERC, fines will vary depending on the customer category, with non-maximum demand users facing penalties ranging from ₦100,000 to ₦300,000. Maximum demand customers caught stealing electricity will be fined between 450% and 600% of their last recorded energy consumption.

The Amended Order on Unauthorized Access, Meter Tampering, and Bypass, which officially replaced Order No: NERC/REG/41/2017, came into effect on January 22, 2025. NERC explained that the amendments align with the Electricity Act 2023 and the Customer Protection Regulations 2023, which authorize distribution companies to disconnect unauthorized connections without prior notice and outline reconnection conditions.

The primary objective of the new order is to combat illegal access to electricity, prevent meter tampering, and establish clear procedures for reconnection to ensure compliance.

The directive states that customers who bypass meters or gain unauthorized access must pay administrative fees, including meter replacement costs and reconnection fees.

Further clarification was given that customers found tampering with meters or bypassing connections will only be reconnected once they have paid the required penalties, including the cost of replacing the meter.

For non-maximum demand single-phase residential customers, the fine for a first offense is ₦100,000, with repeat offenders facing ₦150,000. Non-maximum demand three-phase users will incur ₦200,000 for a first offense and ₦300,000 for subsequent offenses. Maximum demand customers, typically businesses and industrial users, will be fined 450% of their last recorded consumption for a first offense and 600% for any further violations.

Power companies have raised alarms over increasing energy theft, which they say has been worsening despite the implementation of stricter penalties.
