Nigerian Police Reinforce Legal Consequences For Obstructing Lawful Arrests

Force Public Relations Officer, Olumuyiwa Adejobi, took to social media on Saturday to clarify the legal implications of such actions. He emphasized the importance of understanding relevant laws, including Section 197 of the Criminal Code Act, Section 42 of the Police Act, 2020, and Section 98 of the same Act.

Adejobi explained that anyone who obstructs or resists a public officer in the performance of their duties is committing a misdemeanor, punishable by up to two years in prison. He further stressed that citizens are legally required to assist police officers during an arrest when requested, as outlined in Section 42 of the Police Act.

Refusal to assist an officer in making an arrest, especially when an officer is in danger or facing resistance, carries a penalty of a fine or imprisonment for up to three months, according to Section 99 of the Police Act.

Additionally, Adejobi warned that individuals who aid or encourage resistance to police arrests could face serious charges under Section 98 of the Police Act, including fines up to N500,000 or imprisonment for six months.
