Emefiele Faces Court Battle As EFCC Fights To Proceed With Corruption Charges

Published

on

The Economic and Financial Crimes Commission (EFCC) has urged Justice Rahman Oshodi of the Lagos State Special Offences Court in Ikeja to dismiss an application filed by former Central Bank of Nigeria (CBN) Governor Godwin Emefiele, which challenges the court’s jurisdiction.....KINDLY READ THE FULL STORY HERE▶

EFCC counsel, Rotimi Oyedepo, SAN, argued that Emefiele’s application was a tactic to hinder the prosecution of economic and financial crimes. He maintained that the state high court has full jurisdiction to hear and determine the case, contrary to Emefiele’s lawyer, Olalekan Ojo, SAN, who claimed the court lacked jurisdiction to hear the matter.

Ojo contended that Emefiele could not be tried in a state high court for alleged abuse of office, citing constitutional and legal concerns. He also challenged the constitutionality of some charges, arguing they were not based on any existing laws.

In response, Oyedepo emphasized that the allegations against Emefiele involve economic and financial crimes, within the EFCC’s mandate, and that the offenses occurred in Lagos, making it the appropriate venue for trial.

Justice Oshodi has scheduled a ruling on the matter for January 7, 2025. Emefiele, along with Herry Omoile, faces charges including accepting gifts, corruption, and fraudulent property dealings, to which they both pleaded not guilty.
