Court Overturns Criminal Summons Against Senator Okpebholo, Cites Legal Errors

An Abuja High Court has dismissed the criminal summons issued against Senator Monday Okpebholo by a magistrate’s court on September 12, 2024, over allegations of certificate forgery.....KINDLY READ THE FULL STORY HERE▶

The ruling, delivered on Friday by Justice Charles Agbaza, declared that the proceedings initiated by Magistrate Abubakar Mukhtar of the Wuse Magistrate Court were void due to jurisdictional overreach and legal errors.

Justice Agbaza agreed with Okpebholo’s defense, which argued that the summons and subsequent proceedings were unconstitutional, illegal, and infringed on the senator’s right to a fair hearing under Section 36 of the 1999 Constitution (as amended).

The summons had required Okpebholo to appear in court on September 20, just before the Edo governorship election, following accusations by Aginbatse, an indigene, who claimed there were discrepancies in Okpebholo’s date of birth on his nomination forms submitted to the Independent National Electoral Commission (INEC).

Okpebholo’s defense counsel, Andrew Emwanta, filed a motion on October 21, arguing that the case was politically motivated and intended to disqualify Okpebholo from the election. Emwanta emphasized that pre-election matters fall under the jurisdiction of the Federal High Court, as outlined in Section 29 of the law.

In siding with Emwanta, Justice Agbaza noted that the magistrate had failed to consider evidence presented by Okpebholo before issuing the summons and thus prohibited further proceedings in the case. However, the magistrate retains the discretion to set a hearing date for matters within his jurisdiction.

The exam, conducted by the Joint Admissions and Matriculation Board (JAMB), will run from April 16 to April 22 in multiple daily sessions.

JAMB Registrar, Prof. Is-haq Oloyede, urged examination officials to remain highly committed and professional, noting that the success of the exercise depends largely on their dedication.

He gave the charge during a virtual final briefing for technical officers ahead of the examination, where he also praised staff, ad hoc personnel, service providers, and technical advisers for their roles in the successful conduct of the mock exam.

Oloyede said many of the issues recorded during the mock exercise were due to poor assessment of centres by some technical officials.

He further stated that incentive packages would be awarded to teams that perform exceptionally, particularly in handling exam materials and submitting timely reports.

Reiterating JAMB’s zero-tolerance stance on malpractice, he warned candidates against bringing prohibited items into examination halls.

He also disclosed that biometric verification and real-time monitoring systems have been deployed to protect the integrity of the exercise.

Candidates whose biometrics cannot be verified, he added, will be rescheduled to write the exam at approved centres.

Meanwhile, a NAN correspondent monitoring proceedings at Aduvie International School, Jahi, reported that the first session scheduled for 8:30 a.m. began slightly behind schedule at about 8:40 a.m.
