UPDATED: Appeal Court Voids Rivers 2024 Budget Passed By Edison-Ehie Faction. On Thursday, the appellate court dismissed the appeal filed by Rivers State Governor Siminalayi Fubara, stating that it lacked merit. The court noted that Governor Fubara had withdrawn his counter-affidavit at the lower court, making him ineligible to appeal a case he did not contest during the trial phase.
In a unanimous judgment, the court emphasized that Governor Fubara is obligated to follow the rule of law, not the rule of power. It further criticized the situation in the Rivers State House of Assembly, describing it as “executive dictatorship” and a “joke taken too far.”
Previously, Justice Omotosho had annulled the 2024 Rivers budget passed by pro-Fubara lawmakers and ordered the governor to re-submit the budget to the legally recognized House of Assembly led by Martin Amaewhule.
Governor Fubara initially presented the ₦800 billion “Budget of Renewed Hope, Consolidation and Continuity” to only five out of more than 30 lawmakers in December 2023. The court also instructed Fubara to release all funds owed to the Rivers State House of Assembly and prohibited him from interfering in its affairs.
Additionally, the court nullified the redeployment of the assembly’s clerk and deputy clerk, stating that their appointment falls under the speaker’s authority, as outlined in the Rivers State Assembly Service Commission law.
The court further ruled that the Inspector-General of Police and the Nigeria Police Force must continue providing security for all citizens of Rivers State, including members of the state assembly. It also ordered a halt to the planned demolition and reconstruction of the Rivers State Assembly complex.
