Mexico has become the first country in the world to allow citizens to directly elect judges at all levels, a groundbreaking move that has ignited national and international debate. The reform, strongly supported by outgoing President Andrés Manuel López Obrador, was passed in the Senate on Wednesday after intense protests disrupted the legislative process.
The decision marks a significant shift in how Mexico’s judicial system will operate, with over 1,600 judges, including Supreme Court justices, slated to face elections in 2025 or 2027. This reform has been described as a bid to democratize the judiciary, but critics fear it could expose the judicial system to political and criminal manipulation.
Obrador’s Push for Change
The reform was passed with 86 votes in favor and 41 against, surpassing the two-thirds majority needed to amend the Mexican constitution. The ruling Morena party and its allies, who dominate the Senate, pushed the legislation through despite widespread protests.
López Obrador, who leaves office on October 1, 2024, to be replaced by his ally Claudia Sheinbaum, has long argued that the current judicial system serves the interests of Mexico’s political and economic elite. In a press conference following the vote, he criticized the demonstrators, stating, “What worries those who oppose this reform the most is that they will lose their privileges because the judiciary serves the powerful, serving white-collar crime.”
Protests and Political Turmoil
The debate over the reform has triggered mass demonstrations, leading to chaotic scenes in the upper house of Congress. Protesters stormed the Senate chamber, chanting, “The judiciary will not fall,” forcing Senate leader Gerardo Fernández Noroña to declare a recess. Lawmakers were relocated to a former Senate building to resume the debate amid ongoing protests outside.
Critics, including court employees, law students, and human rights organizations, argue that electing judges could compromise the independence of the judiciary. Supreme Court Chief Justice Norma Piña has been one of the most vocal opponents, warning that elected judges could be vulnerable to pressure from powerful criminal organizations, particularly drug cartels. In a public statement, Piña cautioned, “The demolition of the judiciary is not the way forward.”
A Unique Global Precedent
The move to elect judges at all levels has placed Mexico in a unique position globally. While some countries, such as the United States, elect judges at the state level, and Bolivia holds elections for high-level judges, Mexico is now the first nation to implement this system across the entire judiciary.
Margaret Satterthwaite, the United Nations Special Rapporteur on the Independence of Judges and Lawyers, expressed concerns over this new model. She stated, “Without strong safeguards to prevent the infiltration of organized crime into the judicial selection process, an election system may become vulnerable to such powerful forces.”
International and Economic Concerns
The reform has also raised alarm among international allies, particularly the United States. U.S. Ambassador to Mexico, Ken Salazar, warned that the changes could destabilize the country’s legal framework, potentially undermining investor confidence. “This could pose a major risk to Mexican democracy and enable criminals to exploit politically motivated and inexperienced judges,” Salazar stated.
Economic analysts have pointed to a sharp decline in the value of the Mexican peso, which recently hit a two-year low against the dollar, partly driven by investor anxiety over the reforms.
Human Rights and Legal Warnings
Human Rights Watch, along with other advocacy groups, has urged lawmakers to reconsider the legislation, describing it as a dangerous threat to judicial independence. “This proposal seriously undermines judicial independence and violates international human rights standards,” the organization stated.
Supreme Court Chief Justice Piña indicated that the court may consider legal challenges to the reform, but López Obrador dismissed these concerns, asserting that there is no legal basis to block the changes.
