Lagos Residents Criticize Agency Over Demolition Plans Despite Court Order

Residents of Lekki have accused the Lagos State Building Control Agency (LASBCA) and the State’s Ministry of Physical Planning and Urban Development of attempting to illegally demolish their properties despite a court order and a directive from Governor Babajide Sanwo-Olu.

Kenneth Odidika, one of the affected residents, revealed to journalists that LASBCA is trying to dispossess him and his neighbors of their properties under dubious pretenses. He claimed that the agency is acting on behalf of a company that asserts ownership of the land.

Odidika, however, stated that he holds a Certificate of Occupancy and Governor’s Consent for the land, both of which LASBCA has acknowledged.

“Early in December 2022, LASBCA informed us that Minkus Nigeria Limited (the Petitioner) claimed we were squatters on their land. They served us with a Contravention Notice, but we proved we were legitimate residents,” Odidika said.

“They then said we lacked Development Permits. We produced our permits, including C of O and Governor’s Consent, which they acknowledged. When the Petitioner challenged our title in court, we provided proof of ownership, forcing them to withdraw the case. Despite this, LASBCA then accused us of building outside the approved design. Fortunately, Governor Sanwo-Olu announced a 90-day amnesty window starting May 2, 2024, for people to correct such issues.”

Odidika continued, “We applied for assessment and processing immediately, but LASBCA refused, citing a directive to not accept documents from the Maiyegun and Ologolo families due to a land dispute. They used officials, including Honorable Sylvester Ogunkelu, to intimidate us. On May 8, 2024, Hon. Ogunkelu arrived with armed police to mark buildings he claimed belonged to Minkus Nigeria Limited, asking if he could get up to 44 plots from the land.”

In response, the residents secured a court order on May 30, 2024, directing all parties to maintain the status quo pending the case’s resolution. However, LASBCA ignored the court order and, on June 11, 2023, marked the houses for demolition again, even though the 90-day amnesty window has not expired and is set to end on July 31, 2024.

Other residents have called on Governor Sanwo-Olu to intervene, citing significant distress and fear of losing their homes due to LASBCA’s actions.
