This move follows threats from the Academic Staff Union of Universities (ASUU) to embark on a strike due to alleged delays in constituting governing councils. In response, the Federal Ministry of Education had released a list of nominees for chairmen, pro-chancellors, and members of the boards and councils of universities, polytechnics, and colleges of education. The Ministry, under Mamman Tahir, was preparing for a retreat for the nominees and had set the inauguration date for May 31.

Public outcry and allegations that the nominations failed to adhere to the Federal Character principle, with some states receiving disproportionately fewer nominations, have prompted this latest directive from the Presidency. Some states reportedly received only one nomination, while others received multiple, raising concerns about equitable representation.

President Tinubu acknowledged the feedback from across the country and emphasized his commitment to ensuring strict compliance with the Federal Character principle, as enshrined in the Constitution. Onanuga reiterated this commitment, stating that the review will consider national spread and ensure that every part of the country is adequately represented.

Family’s Stance and Expert Testimony Kemi Pinheiro, SAN, appearing for the Adichie-Esege family, acknowledged the legal obligation to respect the High Court’s order. He noted that the family had already prepared extensively for the inquest, having filed four sworn witness statements—including one from Dr. Ivara Esege—alongside reports from medical experts based in Nigeria and the U.S..

Highlighting the need for transparency, Pinheiro urged the court to avoid an indefinite delay, remarking, “The innocent man is not afraid of the lamp; it is the darkness that fears the light”. Counsel for Atlantis Paediatric Hospital echoed this request for a structured timeline rather than an open-ended postponement.

Next Steps As a result of the legal challenge, no witnesses were heard, and the scheduled testimony has been put on hold. Magistrate Adetunji adjourned the matter until October 8, 2026, to receive updates on the High Court’s ruling, which will ultimately dictate when or if the fact-finding process can resume.
