The Socio-Economic Rights and Accountability Project (SERAP) has taken legal action against the Nigerian National Petroleum Company (NNPC) Limited, alleging its failure to account for and explain the whereabouts of an alleged missing $2.04 billion and ₦164 billion in oil revenues. This lawsuit follows allegations outlined in the 2020 audited report by the Auditor General of the Federation, suggesting that the NNPC failed to remit the funds into the Federation Account (FAAC), raising concerns of possible diversion.
SERAP, represented by its lawyers Kolawole Oluwadare and Kehinde Oyewumi, filed the suit at the Federal High Court in Abuja, seeking an order of mandamus to compel the NNPC to account for the missing funds, hand over suspected perpetrators for investigation and prosecution by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) and the Economic and Financial Crimes Commission (EFCC), and ensure the full recovery and remittance of the missing funds into the FAAC.
The suit underscores the public interest in uncovering the details of the missing funds, highlighting their detrimental impact on the country’s economy and deficit spending. It emphasizes the NNPC’s legal responsibility to account for the disappeared funds and the need for transparency and accountability.
According to SERAP, the Auditor-General has consistently reported on the disappearance of public funds from the NNPC over the years, negatively affecting Nigerians who bear the consequences of these missing oil revenues.
The suit outlines specific amounts allegedly unremitted or unaccounted for by the NNPC, including deductions from oil royalties assessed by the Department of Petroleum Resources (DPR), unremitted government revenue, and royalties from crude oil and gas sales and gas flare.
No hearing date has been set for the suit as of yet.
