Court Declines To Halt Impeachment Proceedings Against Philip Shaibu

During Wednesday’s proceedings, Justice James Kolawole Omotoso denied Shaibu’s request for an order of status quo to be maintained by the House of Assembly and other parties involved in the impeachment process pending the determination of his motion on notice.
Shaibu, represented by his lawyer, Professor Olawoyin Awoyale, a Senior Advocate of Nigeria (SAN), orally requested the court to issue the order, citing legal authority to support the application.
However, Justice Omotoso ruled that the cited authority was not applicable in Shaibu’s case because the Governor of Edo State and the Edo State House of Assembly, key players in the impeachment, had not been served with the originating summons of the suit as required by law.
Instead, the judge granted the request for the Edo State Governor and the State House of Assembly to be served with the originating summons by substituted means. This includes pasting the court process at the entrance gates of the Edo State Government House and the State House of Assembly Complex, both in Benin, and serving all court papers to parties through a registered courier company.
The court fixed April 15 for the hearing of the case.
In the motion marked FHC/ABJ/CS/321/2024, Shaibu sought various orders to restrict the defendants from commencing any process related to his removal from office pending the hearing of a motion on notice. These included interim injunctions to prevent adverse actions hindering his official duties as Deputy Governor of Edo State and maintaining the status quo ante bellum prevailing before the issuance of the notice for his removal.

Highlighting his own constituency initiatives and record, Nwebonyi stated he faces no serious competition for his seat and emphasized that public service should be defined by sacrifice rather than personal gain.
Additionally, the Senator expressed strong support for the APC’s prospects in Ebonyi State and lauded President Bola Tinubu for prioritizing infrastructure development in the South-East. He further praised Governor Francis Nwifuru as a unifying leader, dismissing rumors of friction within the Izzi clan and calling on stakeholders to prioritize the state’s collective development over divisive politics.
