The Senate ad hoc committee investigating the disbursement and utilization of the N30 trillion Ways and Means loan secured during the tenure of former President Muhammadu Buhari from the Central Bank of Nigeria (CBN) has unearthed 13 infractions in the process of acquiring the loan.
Chairman of the committee, Senator Isah Jibrin (APC, Benue East), revealed that former CBN governor Godwin Emefiele unilaterally approved billions of naira across various tranches of the loan without adhering to due process.
Senator Jibrin highlighted that Emefiele signed billions of naira in 13 documents without proper authorization.
This revelation was made during an interactive session on Tuesday with the CBN team, led by Bala Bello, one of the deputy governors of the apex bank.
The committee chairman emphasized that Emefiele should have obtained approval for the loans in collaboration with the CBN board of directors, rather than unilaterally signing them, which contravenes the provisions of the CBN Act.
“We need to ascertain the total amount of the ways and means loan. We need to know the cumulative figure,” Senator Jibrin stated.
He commended the CBN’s efforts in the Anchor Borrowers Programme, acknowledging a completion rate of approximately 70%, but stressed the importance of completing the remaining 30%.
Senator Jibrin further announced the committee’s intention to summon the current CBN governor, Olayemi Cardoso, to provide a detailed account of his knowledge regarding the ways and means.
“The incumbent governor, who succeeded Emefiele, should be able to provide insights into Emefiele’s actions, as he took over from him, including knowledge of his assets,” he asserted.
Emphasizing the need for accountability, Senator Jibrin affirmed, “Emefiele should offer an explanation to the current governor. We will extend an invitation to the governor, and if he is unable to provide a response, he will be directed to contact Emefiele.”

This ruling leaves the previous decisions of the Federal High Court and the Court of Appeal, both of which favored the APP, final and binding. The initial legal challenge aimed to force the Independent National Electoral Commission (INEC) to deregister the party, alleging it did not meet the requirements set out in Section 225A of the 1999 Constitution.
The Court of Appeal in Owerri had previously dismissed these claims, with the court noting that the APP provided valid evidence of its electoral success, such as winning a councillorship seat in Jigawa State and victories in local government elections in Rivers State. The appellate judges also supported the interpretation that Section 225A should be read disjunctively, meaning a party only needs to meet one of the stipulated conditions to remain registered.
With this definitive ruling from the Supreme Court, the legal threats against the party’s leadership and its ability to participate in the 2027 general elections have been resolved in the party’s favor.
