This move comes amidst the internal crisis within the APC in Edo State, which erupted following the primary elections held on February 17 and 22.
The initial primary on February 17 resulted in three winners, including Idahosa, while a rerun primary conducted on February 22 declared Monday Okpebholo as the winner with 12,433 votes, surpassing Idahosa’s 6,541 votes.
In a letter addressed to the Chairman of INEC, Mahmood Yakubu, through his lawyer, Wole Olanipekun (SAN), Idahosa requested that INEC recognize him as the Edo APC governorship candidate, asserting that he emerged as the winner of the primary election.
The letter, dated March 4, 2024, referred to a lawsuit marked FHC/ABJ/CS/274/2024 between Idahosa and Okpebholo, urging INEC not to accept any other candidate’s name apart from his.
Idahosa contested the validity of the supplementary or rerun election, maintaining that he had already won the primary on February 17, which was monitored by INEC. He argued that there was no justification for the subsequent election won by Okpebholo.
According to Olanipekun, the February 22 election was not an independent event but a continuation of the February 17 exercise. He emphasized that the results from the February 17 primary should not be disregarded.
He stated, “The summation of the votes in both results demonstrates that our client won the primary election even if his votes from the 17th February 2024 results are the only ones reckoned with.”
Olanipekun further referenced previous supplementary elections conducted by INEC, highlighting the need for consistency in electoral procedures.
The defendants in the lawsuit include the APC and INEC, with Idahosa seeking legal redress to affirm his victory in the primary election.
