“Ex-Oyo Deputy Governor’s Impeachment Appeal Hearing Scheduled For February 8, Court Announces”

The first and second respondents in the appeal are the Oyo State House of Assembly and Clerk, with the Chief Justice of Oyo State, the Attorney-General, and Kayode Christopher as the third to fifth respondents.
Justice Yargata Nimpa, leading the appeal panel, fixed the hearing date after granting the application for an extension of time for the brief of argument filed by Mr.
Samuel Oyadoyin, counsel to the first and second respondents. The panel also approved the motion by the appellant’s counsel, Mr. Kazeem Gbadamosi, SAN, to consider the appellant’s reply brief of November 23, 2023, as properly filed before the court.
Before granting the application and motion, the panel sought the opinion of Mr. O.A. Ogunniran, Director of Litigation in the state Ministry of Justice and counsel to the third and fifth respondents, who expressed no opposition.
“The application for an extension of time to file a brief of argument of the first and second respondents and the motion of the applicant are granted. The case is adjourned to February 8 for hearing,” stated Nimpa.
It is recalled that Justice Bayo Taiwo of Oyo State High Court had declared the process of Olaniyan’s impeachment constitutional in a judgment on January 9, 2023, upholding the impeachment.
Unhappy with the judgment, Olaniyan sought redress at the appellate court, urging it to set aside the decision and nullify his impeachment for non-compliance with constitutional provisions and a lack of fair hearing.
The former deputy governor faced allegations of financial recklessness, misconduct, and insubordination, leading to his impeachment by the assembly.
