During the proceedings on Thursday, Chief Wole Olanipekun SAN requested the Supreme Court to overturn the decisions of the Appeal Court and the Tribunal. Specifically, Olanipekun urged the five-member Apex Court panel, led by Justice John Inyang Okoro, to determine whether INEC guidelines could be a basis for nullifying an election won by a candidate with a margin exceeding 100,000 votes. Olanipekun argued that it was unprecedented for an election to be annulled due to unsigned or unstamped ballot papers.

The governor’s legal team contended that the issue of the governor’s membership in the NNPP was a pre-election matter, challenging the jurisdiction of the Court of Appeal to hear the case. Olanipekun emphasized the unfairness of the lower courts’ judgment and urged the Supreme Court to overturn it.

In response, Chief Akin Olujimi, representing the APC, maintained that the Electoral Act requires INEC presiding officers to sign the back of ballot papers after elections for them to be considered legal. Olujimi argued that the tribunal found the ballot papers were not signed or dated, leading to the cancellation of the election in question due to electoral irregularities.

INEC’s counsel, Abubakar Balarabe Mahmoud, supported Olanipekun’s arguments, claiming that the decisions of the lower courts were flawed. Mahmoud contended that the tribunal exceeded its powers by scrutinizing each ballot paper in chambers instead of in open court.

NNPP’s counsel, Chief Adegboyega Awomolo SAN, asserted that the tribunal was wrong to recount the ballots in its chambers and argued that the absence of signatures on ballot papers should not invalidate the election.

After considering the arguments, Justice Okoro reserved judgment on the governor’s appeal. The tribunal had previously nullified Yusuf’s election in September, citing over 160,000 invalid votes due to missing signatures and stamps on the ballot papers. The APC had contested the election outcome, alleging electoral malpractice, leading to an appeal by Yusuf. The Court of Appeal had dismissed NNPP’s appeal against the tribunal’s judgment, affirming Nasiru Yusuf Gawuna as the winner of the governorship poll held on March 18.
