PDP Demands: INEC Must Conduct Fresh Elections In Rivers Constituencies Vacated By Defectors (Details)

The party clarified on Tuesday that, in accordance with Section 109 (1)(g) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the lawmakers have automatically forfeited their seats by defecting from the PDP, the platform through which they were elected into the House of Assembly.
The statement issued by PDP’s acting national chairman, Umar Iliya Damagum, emphasized that the former lawmakers voluntarily vacated their seats without any compulsion, fully aware of the consequences of defection. The party maintained that there is no division within the PDP to justify the defection, and therefore, the only avenue for the former lawmakers to return to the House of Assembly is through a fresh electoral process, seeking nomination and re-election on the platform of any political party of their choice.
The PDP stressed that the Speaker of the Rivers State House of Assembly had officially declared the seats of the defected members vacant in line with Section 109 (1)(g) of the 1999 Constitution (as amended). The party asserted that the Assembly, having fulfilled its role in this matter, cannot re-admit the former lawmakers without a fresh election.
Furthermore, the PDP cautioned the defected members against false hope or impracticable assurances in Abuja, emphasizing that the Independent National Electoral Commission (INEC) cannot be stopped from conducting fresh elections in the 25 Rivers State Constituencies where vacancies have occurred due to the defection.
The party demanded that INEC, in line with constitutional provisions, fix a date for the conduct of fresh elections into the 25 State Constituencies in Rivers State where vacancies have emerged due to the defection of the former members of the Rivers State House of Assembly, pending the resolution of any legal proceedings in court.
