Nigerians React As Senior Advocates Of Nigeria (SANs) Rally Against Fraud Allegations On Judges-Threat To Judicial Legitimacy
A group of Senior Advocates of Nigeria, SANs, has voiced its opposition to broad allegations of fraud and corruption directed at judges and the judiciary in response to certain contentious decisions made by a few judges in political cases. Notable among the Senior Advocates expressing their dissatisfaction are Chief Mike Ahamba, SAN, a former Abia State Attorney-General and Commissioner for Justice, Professor Awa Kalu, SAN, human rights activist Mr. Kunle Adegoke, SAN, and constitutional lawyer Dr. Olukayode Ajulo, SAN.
These legal experts, in contrast to some of their colleagues, argued that portraying the judiciary as a failed institution essentially endorses anarchy and jeopardizes the Nigerian project. They acknowledged that while a few judges had recently rendered controversial judgments in political cases, condemning the entire judiciary for these isolated incidents was unjust to the majority of upright judges faithfully performing their duties.
Furthermore, the dissenting lawyers contended that such a blanket criticism had the potential to undermine the legitimacy of the judiciary, which relies on public perception. They acknowledged that while there were instances of flawed judgments, the severity of these mistakes should not lead to a wholesale condemnation of the entire judicial system. The lawyers urged their colleagues to exercise caution and handle situations involving incorrect judgments more judiciously.
Several of these legal professionals, including Mr. Kunle Adegoke, SAN, highlighted the importance of recognizing the positive contributions of the majority of judges who diligently uphold the law. They cautioned against a general campaign tarnishing the judiciary’s image, emphasizing its negative impact not only on the international reputation of the country but also on its internal stability. Professor Awa Kalu, SAN, added a cautionary note, advising lawyers to be careful in their criticism and not forget the inherent complexities in legal proceedings.
The lawyers collectively stressed the need for a more nuanced approach to criticizing the judiciary, advocating for academic analysis and critique in law journals as a constructive way to contribute to the development of legal jurisprudence, rather than resorting to public condemnation.
