Breaking: Enugu Business Owners Sparks Legal Battle Against Governor Mbah For Property Demolition

The case, with reference No/FHC/EN/CS/168/2023, filed at the Federal High Court, bears the title Messrs. U. Maduka & 11 Ors V. Enugu Capital Territory Development Authority & 6 Ors.
Through an Originating Summons, the plaintiffs are seeking clarification on Sections 5(3) b), 1, and 49 of the Land Use Act, particularly concerning the authority of the state government over federal lands within the state. They also seek a perpetual injunction to prevent the Enugu State Government and its agencies from interfering with the rights of the occupants.
The plaintiffs, represented by their counsel, have posed three questions for determination and formulated five reliefs. In the event of favorable answers to their questions, the plaintiffs are seeking various declarations and an injunction against the defendants. Additionally, they are requesting One Hundred Million Naira (N100,000,000.00) in damages from the 1st and 2nd defendants for the alleged arbitrary and unconstitutional issuance of removal notices.
Meanwhile, one of the plaintiffs’ counsels, Bona Ononugbo, expressed concern over the government’s misuse of power during a press conference. He highlighted that while the plaintiffs initiated legal action on November 16, 2023, the state government, in what he deemed an abuse of the judicial process, filed a separate action on November 20, 2023, at the State High Court. This action targeted the Nigeria Railways Corporation and other occupants, some labeled as unknown persons.
Ononugbo criticized the government for not disclosing critical facts to the court and accused it of pursuing a land-grabbing scheme under the guise of a bus terminal project. He asserted that the government’s actions lacked transparency and honesty, suggesting a hidden agenda behind the purported public interest project.
