The Court of Appeal in Abuja has rejected an appeal seeking to prevent former Minister of State for Petroleum Resources, Timipre Sylva, from participating in the Bayelsa state governorship election scheduled for Saturday, November 11.
In a judgment delivered on Thursday evening by a three-member panel, the court ruled that the appeal brought by Hon Isikima Ogbomade Johnson lacked merit. Justice Binta Zubar, who read the judgment, deemed the subject matter non-justiceable and asserted that the case was brought in bad faith.
The court upheld Sylva’s argument that he did not take the oath of office as governor twice, as his first election was voided by the courts. This led to another election, which he won.
Rejecting the appellant’s claim that the APC primary election on April 14, which produced Sylva as the party’s candidate, violated relevant laws, the appellate court stated that the evidence presented by INEC and APC demonstrated compliance with legal provisions.
The court emphasized that the appellant’s case was statute-barred, filed outside the 14-day window allowed by law for pre-election matters. It upheld the judgment of the Federal High Court in Abuja delivered by Justice Inyang Ekwo on September 26, which dismissed Mrs. Johnson’s suit for lacking merit and substance.
In addition, the Court of Appeal imposed a cost of N1 million against the appellant, who had sought Sylva’s disqualification on the grounds of alleged dual governorship office and an illegal primary election.
