The Court of Appeal, located in Lagos State, has affirmed the election victory of Cyriacus Sunday Umeha, who represents the Ezeagu/Udi Federal Constituency in the House of Representatives. This ruling overturns the judgment of the National Assembly Election Petitions Tribunal, which had previously annulled Umeha’s victory.
The three-judge panel of the appellate court determined that the trial tribunal’s decision was incorrect in law, as it concluded that Umeha had not resigned from his previous political party, the PDP. The court emphasized that issues concerning the nomination and sponsorship of candidates are entirely pre-election matters.
Previously, a tribunal led by Justice A.M. Abubakar had declared Festus Uzor of the PDP as the winner of the February 25 election. Dissatisfied with this decision, the Labour Party and its candidate, Umeha, appealed to the Court of Appeal, seeking to overturn the lower court’s judgment.
The Court of Appeal found that, based on the presented evidence, Umeha had indeed resigned from the PDP before running for election under the Labour Party. Consequently, the court ruled that Festus Uzor’s petition at the trial level lacked merit and should have been dismissed.
