The Central Bank of Nigeria (CBN) has raised concerns regarding the legal basis for human rights lawyer Femi Falana’s request to the Federal High Court to halt the concerning devaluation of the Naira. In a preliminary objection filed against Falana’s lawsuit regarding the Naira’s falling value and the dollarization of the economy, the CBN has questioned Falana’s eligibility and the court’s jurisdiction to address the matter. Additionally, the CBN has sought the case’s dismissal on the grounds that it has exceeded the statute of limitations.
Falana, in case number FHC/L/CS/470/23, had asked the court to order the CBN to prevent market forces from determining the Naira’s exchange rate in line with Section 16 of the Central Bank Act. He also requested the court to compel the CBN to halt the dollarization of the economy, as Section 20(1) of the Act designates the Naira as the sole legal tender in Nigeria.
However, in the preliminary objections presented by Adeleke Agboola, SAN, on behalf of the CBN, the central bank argued that Falana has not demonstrated that he would be disproportionately affected by the CBN’s exchange rate policy compared to other Nigerian citizens. The CBN asserted that Falana lacks the legal standing to initiate the case and has not reported those involved in dollar trading in Nigeria.
Additional objections put forward include the absence of evidence that the CBN acted in bad faith and the failure of the plaintiff to present a reasonable cause of action against the CBN. The bank has asked the court to either dismiss the case or, as an alternative, strike it out, citing its lack of jurisdiction to hear the matter.
