Former chairman of Nigeria’s Independent National Electoral Commission (INEC), Prof. Attahiru Jega, has called for revisions to the Electoral Act of 2022. Speaking at a two-day retreat organized for senators by the National Institute for Legislative and Democratic Studies in Akwa Ibom State, Jega pointed out that while Nigeria’s electoral law represents a significant improvement, it still contains ambiguities that require further clarification and strengthening.
Jega emphasized the need for amendments to make electronic result transmission mandatory for the 2027 general elections, addressing concerns related to Section 64 of the Electoral Act. This amendment would make the transmission of election results compulsory, including uploading polling unit level results and result sheets used in the collation process.
In addition, he proposed that the president should no longer have the power to appoint the chairman and National Commissioners of INEC, aiming to depoliticize the commission.
Jega suggested a review of the law to ensure that all election-related cases are resolved and judgments made before the date of swearing-in. Furthermore, he called for the introduction of early voting for eligible voters on election duty and advocated for diaspora voting, especially for presidential elections.
To enhance women’s inclusion in politics, Jega recommended a 35% representation of women in elective positions in parliament and political parties’ candidate lists. He also suggested proscribing cross-carpeting by elected officials at both the national and state levels and empowering INEC to promptly fill vacancies resulting from such actions.
Jega concluded by proposing stringent conditions for candidate withdrawal and replacement to prevent abuse, allowing candidates outside political parties and tax-paying citizens to file suits against candidates providing false information to INEC. Additionally, he called for the restructuring of the process of appointments to INEC, minimizing presidential involvement in appointments, and ensuring a more transparent, non-partisan, and stakeholder-engaged approach.
These proposed amendments aim to further enhance the transparency, integrity, and inclusivity of Nigeria’s electoral system.
