The 2023 presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, has put forth his arguments for the Supreme Court’s acceptance of fresh evidence against President Bola Tinubu. Atiku insists that the apex court should not dismiss his opportunity to present new evidence obtained from Chicago State University (CSU) regarding the petition against Tinubu, as it would substantiate his claim that the All Progressives Congress (APC) candidate was ineligible to contest the 2023 presidential election.

Atiku made this submission in response to the legal objections raised by President Tinubu, the Independent National Electoral Commission (INEC), and the APC concerning the admissibility of documents provided by Chicago State University in the United States of America. Additionally, Atiku asserted that this evidence would not only demonstrate Tinubu’s ineligibility but also suggest his involvement in certificate forgery.

The documents in question, comprising a 32-page record of Tinubu’s academic history, were released to Atiku by order of Judge Nancy Maldonado of the District Court of Illinois, Eastern Division, United States, despite Tinubu’s objections.

While there have been arguments against the acceptance of fresh evidence at this stage of the case, Atiku, represented by his legal team led by Chris Uche (SAN), contended that no constitutional limit of 180 days on lower courts should prevent the Supreme Court from exercising its powers. He emphasized that the Constitution takes precedence over other legislation and that the 180-day limitation applies only to Election Tribunals, not the Court of Appeal, which has jurisdiction over presidential election disputes.

Atiku argued that the Presidential Election Petition Court (PEPC) that heard and dismissed his petition was not an election tribunal, as Section 285(6) of the 1999 Constitution limited the 180-day rule to election tribunals while excluding the Court of Appeal. He further cited relevant sections of the Constitution that explicitly granted jurisdiction to the Court of Appeal for presidential election disputes.

Uche highlighted that the case revolves around whether Tinubu presented a forged certificate to INEC, rather than the mere attendance of Chicago State University. During the trial, a National Youth Service Corps (NYSC) certificate bearing serial number 173807, presented by Tinubu to INEC, was tendered by the Appellants/Applicants as “EXHIBIT PBD 1A,” featuring the name Tinubu Bola Adekunle.

The Supreme Court has scheduled a hearing on Atiku’s petition against Tinubu for Monday, October 23, 2023.

The announcement was made via its official social media platform, indicating that deployment details are now available following the earlier publication of the orientation timetable.

The long-standing legal battle involves the 15th Emir of Kano, Aminu Ado Bayero, and the 16th Emir, Muhammadu Sanusi Lamido, both of whom are contesting the legitimacy of the Kano Emirate throne.

At its first sitting on the matter, the apex court listened to preliminary submissions from the parties before deciding to adjourn the case to the 2027 date.

The suit was filed by Aminu Babba Dan Agundi, who is challenging the actions of the Kano State Government and the State House of Assembly, particularly the repeal of the 2019 Kano Emirates Law. The legal challenge also addresses the dissolution of the five emirates established during the administration of Abdullahi Ganduje, as well as the reinstatement of Sanusi, who was removed from the throne in 2020.
