The Independent National Electoral Commission (INEC) has expressed its apprehension regarding the enduring litigious nature of elections in Nigeria since the advent of the current democratic era in 1999. INEC has also decried the recurring issue of conflicting court judgments, which has become a common occurrence in Nigeria’s electoral jurisprudence and is detrimental to the electoral process.
These twin problems are attributed to the prevailing political culture in the nation. During a two-day workshop for members of the INEC Press Corps in Akwanga, Nasarawa State, Barrister Toyin Babalola, the Director of Legal Drafting and Contracts at INEC, emphasized the importance of political parties upholding the principles of internal democracy. She stressed the need for these parties to ensure that their selection of candidates accurately reflects the preferences of their party members during primary elections.
Babalola argued that adhering strictly to the principles of internal democracy and ensuring that candidate nominations align with the will of party members could significantly reduce the frequency of pre-election disputes and their adverse effects on the electoral process.
She stated, “Elections conducted since the inception of democracy have been litigious, owing to our political culture. It is essential that political parties rigorously preserve the principles of internal democracy by ensuring that the nomination of candidates aligns with the will of their members at party primaries. This can reduce the number of pre-election issues and their impact on election preparations.”
Babalola also pointed out that election challenges are an integral part of the electoral processes of constitutional democracies worldwide. She added, “In Nigeria, like other representative democracies, electoral laws provide for the resolution of electoral disputes through legal proceedings, known as pre-election and post-election (Election Petitions) cases. The challenges associated with litigation are not limited to pre-election cases. Lack of internal party democracy, non-adherence to party constitution and guidelines, arbitral replacement of candidates, nomination of placeholders, and more are factors that affect election preparations.”
She further stated that conflicting court judgments have become a recurrent issue in Nigeria’s election jurisprudence, negatively impacting the electoral process. This inconsistency has led to uncertainty and a loss of confidence in the system, ultimately affecting the electoral process.
