Court Rejects No-Case By Late Gospel Singer Osinachi’s Husband, Mr Peter Nwachukwu’s Request Dismiss Homicide And Domestic Violence Charges....KINDLY READ THE FULL STORY HERE▶
The Federal Capital Territory High Court, Wuse Zone 2, Abuja, has rejected the application made by Peter Nwachukwu, the husband of the late gospel singer Osinachi Nwachukwu, seeking to challenge the homicide and domestic violence-related suit brought against him by the Office of the Attorney-General of the Federation on June 3, 2022.
The court has determined that the federal government has presented a compelling case against him, and he is now required to present his defense in the matter.
Osinachi Nwachukwu tragically passed away on April 8, 2022, with allegations from her colleagues suggesting that her husband had physically abused her. Following these accusations, Nwachukwu was taken into custody by the Nigerian police.
Upon his arraignment, Justice Njideka K. Nwosu-Iheme ordered the defendant’s remand at the Kuje Correctional Facility until the case is heard and decided. Nwachukwu had pleaded not guilty to a 23-count charge, including domestic violence and homicide.
The trial began on June 20, 2022, with the prosecution presenting 17 witnesses and ultimately closing its case on March 10, 2023.
Nwachukwu’s lawyer, A. Aliyu, then submitted a no-case application, suggesting that his client had no obligation to defend himself.
Aliyu argued that the medical practitioners’ testimony exonerated his client from the culpable homicide charge. He pointed out that the medical experts confirmed that the deceased did not suffer any violence leading to her death, and the autopsy revealed that her death was primarily due to outgrowth tumors, resulting in cardiac tamponade, with an abnormal tissue growth (cancer) as the secondary cause of death.
The lawyer further accused Nwachukwu’s in-laws of attempting to frame him, emphasizing that the autopsy “indicated the absence of any signs of violence on the deceased when the autopsy was conducted.”
In her ruling on the no-case application, Justice Nwosu-Iheme declared that the prosecution had established a prima facie case against the defendant and ordered him to present his defense.
The court has set November 22 and 23 for the commencement of the defense proceedings.

Case Background and Prosecution
The convicts were apprehended following a violent cult clash at the Ikenne Town Hall on October 23, 2023, which severely disrupted public peace and local activities.
Prosecuting officer ASP Olaide Rawlings established during the trial that Okusanya belonged to the Eiye Confraternity, while Gafar was affiliated with the Alora Confraternity, alongside other accomplices currently at large. Their actions violated several provisions of the Prohibition of Forcible Entry and Occupation of Landed Properties, Armed Robbery, Cultism, Kidnapping and Other Anti-Violent and Related Offences Law of Ogun State, 2016.
Finding the prosecution’s evidence credible and compelling beyond a reasonable doubt, Magistrate Oke delivered the sentence to serve as a strict deterrent against unlawful secret societies and violent disturbances in the state.
