Telecommunication companies in the country have issued a stern warning, indicating their intention to take legal action against banks for their failure to settle a N120 billion debt related to Unstructured Supplementary Service Data (USSD).
The telecommunications companies, who are also considering the possibility of suspending USSD services, have reached the conclusion that pursuing legal action may be their only recourse. This decision has been prompted by the banks’ persistent delays in clearing the long-standing N120 billion debt.
Gbenga Adebayo, Chairman of the Association of Licensed Telecoms Operators of Nigeria, expressed their frustration and limited options, as the banks have shown reluctance in addressing this debt, which has been pending for four years.
Adebayo clarified that telcos maintain the right to suspend USSD services to banks due to the nature of their commercial agreement. However, certain political factors have complicated the possibility of suspending these services.
He emphasized, “I think it’s best to suspend the services. When it comes to this issue of USSD debt, if parties must resort to legal action for a final resolution, then so be it. This is because every effort that has been made, whenever progress has been achieved, seems to be followed by several steps backward.”
Adebayo pointed out that the agreement, which has deteriorated into a debt dispute, originally had provisions for third-party interventions, including arbitration and legal resolution. He added that political interference has complicated the issue.
The recent intervention by Minister of Communications, Innovation, and Digital Economy, Dr. Bosun Tijani, involved expressing sympathy for the telcos regarding the debt. The minister admonished the banks, emphasizing that they should not expect to receive services for free, as there are costs associated with the services rendered.
