The Allied Peoples Movement (APM) has submitted a 10-point Appeal to the Supreme Court, contesting the ruling of the Presidential Election Petition Court and requesting the annulment of President Bola Tinubu’s victory.

In their appeal, represented by their new counsel, Chukwuma – Machukwu Ume, the APM urges the highest court to overturn the judgment of the Presidential Election Petitions Court (PEPC) due to multiple legal errors.

They argue that sections 131 and 142 (1) of the 1999 Constitution are intricately linked and cannot be treated merely as pre-election matters, as these qualifications are fundamental prerequisites for being elected as President.

The appellant’s argument is not solely based on Tinubu’s nomination but primarily on the fact that President Tinubu participated in the presidential election without a legitimate running mate.

The party also contends that the withdrawal of Ibrahim Kabir Masari and the expiration of the 14-day window for changing, withdrawing, or replacing candidates under Section 33 of the Electoral Act 2022 invalidate Tinubu’s election and return.

According to the party, the PEPC neglected its responsibility and jurisdiction to address APM’s query regarding whether President Bola Ahmed Tinubu and Kashim Shettima were “validly elected” to the positions of President and Vice President, as mandated by Section 239(1) of the Constitution of the Federal Republic of Nigeria 1999 (as amended).

APM asserts that being “validly elected” encompasses meeting the qualifications to run in the election, including the stipulated constitutional requirements and disqualifications.

They argue that the lower court avoided the substantial issue of valid elections by focusing on technical pre-election matters.

Consequently, APM implores the Supreme Court to uphold the appeal and declare that Tinubu was not eligible to run as the presidential candidate of APC, having violated the provisions of Section 142 (1) of the Constitution of the Federal Republic of Nigeria 1999 (as amended).

Furthermore, the party seeks a declaration that the Independent National Electoral Commission’s (INEC) return of Tinubu as the President-elect is null and void, devoid of any legal validity.

Lastly, APM requests an order to nullify and invalidate all votes garnered by APC in the presidential election held on February 25 and a subsequent order instructing INEC to declare the candidate with the second-highest vote count as the winner of the presidential election.

The exam, conducted by the Joint Admissions and Matriculation Board (JAMB), will run from April 16 to April 22 in multiple daily sessions.

JAMB Registrar, Prof. Is-haq Oloyede, urged examination officials to remain highly committed and professional, noting that the success of the exercise depends largely on their dedication.

He gave the charge during a virtual final briefing for technical officers ahead of the examination, where he also praised staff, ad hoc personnel, service providers, and technical advisers for their roles in the successful conduct of the mock exam.

Oloyede said many of the issues recorded during the mock exercise were due to poor assessment of centres by some technical officials.

He further stated that incentive packages would be awarded to teams that perform exceptionally, particularly in handling exam materials and submitting timely reports.

Reiterating JAMB’s zero-tolerance stance on malpractice, he warned candidates against bringing prohibited items into examination halls.

He also disclosed that biometric verification and real-time monitoring systems have been deployed to protect the integrity of the exercise.

Candidates whose biometrics cannot be verified, he added, will be rescheduled to write the exam at approved centres.

Meanwhile, a NAN correspondent monitoring proceedings at Aduvie International School, Jahi, reported that the first session scheduled for 8:30 a.m. began slightly behind schedule at about 8:40 a.m.
