The Independent National Electoral Commission (INEC) had previously declared Rev. Fr. Hyacinth Alia, the All Progressives Congress (APC) candidate, as the winner of the election. Dissatisfied with the announced results, the Peoples Democratic Party (PDP) candidate, Titus Uba, and the PDP itself, filed a petition with the tribunal, seeking to nullify Alia and the APC’s victory.

In their closing arguments, the PDP and its candidate, Titus Uba, implored the tribunal to void the declaration of Alia and his Deputy, Samuel Ode, as winners of the March 18, 2023 governorship election. They alleged forgery and a late nomination in their appeal.

Conversely, counsels representing INEC, Governor Alia (Samuel Ameh), Deputy Governor Ode (Mamman Osuman), and the APC (Mathew Burkaa), all Senior Advocates of Nigeria, urged the tribunal to dismiss the petition due to its lack of merit.

Following these submissions, the three-member panel, led by Justice Ibrahim Karaye, adjourned the case for judgment, with the date to be communicated to all parties involved. Apprehension has been palpable in the state since the tribunal reserved its judgment.
