In a ruling sighted on Friday but delivered on August 26, Justice Salim Ibrahim struck out the suit (marked FHC/ABJ/CS/1569/2026) after establishing that a court of coordinate jurisdiction had already adjudicated the same controversy.
Araraume had approached the court through his counsel, George Ibrahim, SAN, asking that Senator Patrick Ndubueze’s submission on the INEC portal be set aside and replaced with his own name, following the uploading of Ndubueze’s particulars on July 11. He sued the APC, Ndubueze, and INEC, grounding his application in the 1999 Constitution, the Electoral Act 2026, and party guidelines.
However, Ndubueze’s legal team, led by Prof. Paul Ananaba, SAN, filed a preliminary objection arguing that the suit constituted an abuse of court process. They pointed out that the Federal High Court in Owerri had already delivered a judgment on June 25 in a related suit concerning the APC primary held on May 18.
INEC, represented by Johnson Usman, SAN, maintained a neutral stance, noting that it merely processed candidate nominations via its portal as submitted by political parties, which still listed Ndubueze.
Prior to evaluating the substantive merits, Justice Ibrahim prioritized the question of jurisdiction in alignment with Supreme Court precedents. Upholding the preliminary objection, the judge ruled that entertaining Araraume’s fresh action would amount to an abuse of judicial process since a court of coordinate jurisdiction had already addressed the underlying dispute.
Justice Ibrahim emphasized that a subsisting judgment from another division—in this case, delivered by Justice I.N. Owoibo in Suit No. FHC/OW/CS/70/2026—must be respected by courts of equal rank unless set aside on appeal, regardless of any perceived errors. Consequently, the court struck out the suit with no order as to costs.
