The decision emerged from an August 20 meeting between DSS Director-General Tosin Ajayi, the legal directorate, and the senior lawyer handling the case—convened just a day after the Independent National Electoral Commission (INEC) lifted the ban on presidential campaigns. According to a source speaking with The Nation, the DSS chief reasoned that pausing a case already in court for nearly another four months would make little difference, noting it is only fair to let Sowore participate fully in the electoral race.

The legal tussle stems from August 2025 social media posts on and Facebook where Sowore labeled President Bola Tinubu a “criminal.” Following his non-compliance with a seven-day ultimatum to take down the posts, the DSS bypassed an arrest and instead approached the Federal High Court on September 16, 2025, seeking a judicial interpretation to fulfill its mandate of protecting the President from both physical and psychological attacks.
