Recalling the legal timeline, Ifedi noted that the Court of Appeal had previously acquitted and discharged Kanu on October 13, 2022, throwing out eight counts (counts 6 through 12, and 14) out of a 15-count charge for failing to disclose an offense. However, in a December 15, 2023 judgment, the Supreme Court set aside that decision and remitted the trial back to the Federal High Court.
Ifedi has raised two major legal questions regarding the apex court’s actions:

Revival of Quashed Charges: He challenged the court to point to the specific law that authorized it to resurrect the seven counts previously thrown out by the Court of Appeal, arguing that appellate jurisdiction alone does not grant the power to revive a quashed charge.

Alteration of Statutory Foundations: He questioned the legal basis for the Supreme Court substituting the statutory foundation of count 15 (later renumbered as count 7), where the court dismissed a citation error regarding the Criminal Code Act versus the Customs and Excise Management Act (CEMA) as a “mere mistake” and supplied the correct law itself.
Emphasizing that the Supreme Court is not supreme over the law, Ifedi argued that judicial policy or general terrorism jurisdiction cannot replace missing legal foundations, rewrite criminal statutes, or magically restore the legal status of dead charges. He further contended that subsequent events like Justice Binta Nyako’s recusal and the taking of a fresh plea cannot answer the fundamental jurisdictional question of how quashed counts were legally made cognisable again, concluding that the Supreme Court overstepped its role as a neutral arbiter.
