Alloy Ejimakor, the special counsel to the IPOB leader, announced the development, confirming that he received formal communication stating that the administration of President Bola Ahmed Tinubu is no longer pursuing its cross-appeal on the matter. According to Ejimakor, representations had earlier been made highlighting that capital punishment conflicts with international law.

In a social media update, the lawyer stated: “UPDATE: By virtue of a formal communication I received 2 days ago, I can confirm that the Nigerian government ‘does not intend to pursue their cross appeal on the question of the mandatory death penalty’ against Mazi Nnamdi Kanu. Case closed.”

This legal pivot follows a previous push in November 2025, where prosecutors demanded a death sentence under the Terrorism Prevention Amendment Act. However, Justice James Omotosho of the Federal High Court in Abuja had earlier dismissed that request, opting instead for a life sentence while citing modern global trends shifting away from capital punishment.
